TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 2015

BASINGSTOKE AND DEANE (BASINGSTOKE TOWN CONSERVATION AREA) ARTICLE 4 DIRECTION

NOTICE IS HEREBY GIVEN that Basingstoke and Deane Borough Council as the appropriate Local Planning Authority within the meaning for Article 4(5) of the Town and Country Planning (General Permitted Development) Order 2015 ("the Order") made a Direction, under Article 4(1) of the Order on 29 September 2015 regarding the BASINGSTOKE OLD TOWN CONSERVATION AREA now referred to as the BASINGSTOKE TOWN CONSERVATION AREA.
The effect of the Direction:
Permitted development rights under the Order for development set out below in the below Schedules shall be removed. Planning permission will therefore be required for these types of development from the date the Article 4 Direction is in force.
Date of operation:-
The Direction shall come into force on 15 October 2015 for no longer than 6 months unless and until it is confirmed by the Council within this time.
Representations:-
The period for representations begins on the date of Monday 19 October 2015 and ends on 09 November 2015. All representations in respect of this Direction must be sent in writing to the undersigned by 09 November 2015. Full details of this Direction, together with the Plans and a copy of the Direction as made may be inspected from Monday to Friday during normal office hours at Civic Offices, London Road, Basingstoke, Hampshire RG21 4AH . SCHEDULE ONE
1. Development which would otherwise be permitted within:

a) Class A of Part 1 of Schedule 2 of the said Order, consisting of any improvement or other alteration to a dwellinghouse where the alteration fronts a relevant location;

b) Class C of Part 1 of Schedule 2 of the said Order, consisting of any alteration to the roof of a dwellinghouse (including a change of roof material and installation of roof lights) where the alteration would be to a roof slope which fronts a relevant location;

c) Class D of Part 1 of Schedule 2 of the said Order consisting of the erection or construction of a porch outside any external door of a dwellinghouse where the external door in question fronts a relevant location;

d) Class E Part 1(a) of Schedule 2 of the said Order consisting of -

e) the provision within the curtilage of the dwellinghouse, of a building, enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwellinghouse as such, or the maintenance, improvement or other alteration of such a building or enclosure, which fronts a relevant location.

f) Class F Part 1 Schedule 2 of the said Order consisting of the provision within the curtilage of a dwellinghouse of a hard surface for any purpose incidental to the enjoyment of the dwellinghouse as such where the hard surface would front a relevant location; Class G of Part 1 of Schedule 2 of the said Order, consisting of the installation, alteration or replacement of a chimney, flue or soil and vent pipe on a dwellinghouse or on a building within the curtilage of a dwellinghouse;

g) Class A of Part 2 of Schedule 2 of the said Order consisting of the erection or alteration of a gate, fence, wall or other means of enclosure being where the gate, fence, wall or other means of enclosure would be within the curtilage of a dwellinghouse and would front a relevant location.

h) Class C Part 11 Schedule 2 of the said Order consisting of the erection, construction, improvement or alteration (including demolition) of the whole or part of any gate, fence, wall or other means of enclosure within a curtilage of the dwellinghouse and which fronts a relevant location.

i) Class C of Part 2 of Schedule 2 of the said Order, consisting of the painting of the exterior of any building or work which would front a relevant location.

2. This Schedule shall apply to the land more particularly described in Schedule 3(a)

SCHEDULE TWO
1. Development which would otherwise be permitted within:

a) Class C of Part 2 of Schedule 2 of the said Order, consisting of the painting of the exterior of any building or work which would front a relevant location.
2. This Schedule shall apply to the land more particularly described in Schedule 3(b)

SCHEDULE 3
a) The Article 4 Direction relates to the following area of land:

Basingstoke Town Conservation Area, Basingstoke, Hampshire
- Chequers Road - Nos. 5-11 (odd), No.17, No. 23, Nos. 18 - 28 (even);

- Church Square - Nos. 6-10 (odd and even), Nos. 30 -50 (even), Nos. 19 - 43 (odd), No. 47;

6-10
- New Road - Nos. 38 - 48 (even), Nos. 52 - 58 (even), Nos. 17-27 (odd). 17-27

b) The Article 4 Direction relates to the following area of land:

Basingstoke Town Conservation Area, Basingstoke, Hampshire
Top of Town Character Area, measuring 71894 square metres including properties fronting London Street to the junction with New Road in the east, properties on the western side of New Road between the junction with London Street to the junction with Red Lion Lane, Red Lion Lane, Anchor Yard, Feathers Yard Wote Street to the south of 31 Wote Street, eastern side of Church Street south of Clapham House and western side of Church Street to the junction with Cross Street, properties facing Cross Street, properties fronting New Street south of the junction with Cross Street to the junction with Winchester Street (excluding Copenhagen Court), Market Square, Albert Yard, Caston's Yard, Wolverton Court, Jacob's Alley, Jacob' Yard and Mark Lane.
