TWO men allegedly took advantage of an ‘upset, alone and vulnerable’ 16-year-old, plied her with drugs and alcohol, before raping and sexually assaulting her, a court heard.
Gary Peter Ian Davidson, 34, and Thuc Hung Dinh, 33, went on trial today (Monday) at Winchester Crown Court accused of abusing the victim at Davidson’s caravan in Hatch Park Mobile Home Park in Old Basing in February 2018.
The victim had been drinking and smoking cannabis with her then boyfriend and friends when she decided to leave group and went off by herself.
Opening the case, Mary Aspinall-Miles said: “(The victim) was therefore upset, alone, walking home drunk and vulnerable. The prosecution say that these men took full advantage of that. Both of these men are considerably older than she was and significantly effectively strangers.”
Ms Aspinall-Miles said that Dinh came across the victim and offered her a lift home, but instead took her to Davidson’s caravan where she was offered vodka and cocaine.
“Unsurprisingly (the victim) became even more drunk and under the effects of alcohol or otherwise was invited to go to the bedroom and sleep it off.”
It is alleged that when the victim woke, she found Davidson on top of her and Dinh sexually assaulting her.
“She says no, no, no several times to them and physically tried to push them off and when they ignored her she froze,” Ms Aspinall-Miles said.
Following the alleged attack, Davidson dropped the victim off near to her house. She suspected that the man might have been loosely associated to her family as he had taken her all the way home.
The court was told that the victim carried out some “detective work” and was able to find the two men on social media.
They were later arrested, and Davidson claimed that the victim asked him to sleep with her, but Ms Aspinall-Miles said that “his act is self-serving”, while Dinh has alleged that he was drunk and “couldn’t remember anything else that happened that night”.
Ms Aspinall-Miles told the jury that the victim has admitted that parts of the night are “blacked out and she recalls things in flashbacks”.
Davidson, of Basingfield Close, Basingstoke, has pleaded not guilty to rape and two counts of sexual assault, and Dinh, of New Bridge Lane, Basingstoke, has denied a charge of attempted rape and two counts of sexual assault.
The trial continues.
